• Be responsible for activity under your account.

We may suspend or terminate accounts for violation of these Terms.

4. Early Access / Beta Services

Elyxis is currently offered as an early access / beta service. This means:

• Features may change or be removed,
• Uptime is not guaranteed,
• Data may be lost,
• The Service is provided "AS IS".

Your feedback may be used by us without restriction.

5. Fees & Payment

Some features may require paid subscriptions. Fees, plans, and terms will be shown in your account or on our website.

• Fees are non-refundable unless required by law,
• Taxes may apply,
• Pricing may change with prior notice.

6. Acceptable Use

You agree not to:

• Break any applicable law,
• Attempt to hack, disrupt, or harm the Service,
• Misuse or overload our infrastructure,
• Upload malware,
• Copy or reverse-engineer Elyxis,
• Use Elyxis to build a competing product,
• Share illegal, harmful, or infringing content.

We may investigate violations and suspend access.

7. Intellectual Property

Elyxis retains ownership of all platform intellectual property, excluding "Your Data". You may not copy, distribute, or modify the Service except as allowed by these Terms.

Your Data

You retain all rights to content and data you upload ("Your Data"). You grant Elyxis a license to process and store Your Data as needed to provide the Service.

Our collection and use of personal information is governed by the Privacy Policy. By using Elyxis, you consent to these practices.

9. Third-Party Services

Elyxis integrates with third-party systems (cloud platforms, AI models, identity providers, billing services, etc.). These are governed by their own terms, and Elyxis is not responsible for their performance or security.

Any feedback you submit may be used by Elyxis without obligation or compensation.

Both parties may receive confidential information from the other. Confidential information must be protected and not shared without permission, except as required by law.

The Service is provided "AS IS", without warranties of any kind, including fitness for a purpose, accuracy, reliability, availability, or non-infringement. We do not guarantee uptime or defect resolution.

13. Limitation of Liability

To the fullest extent permitted by law:

• Elyxis is not liable for indirect, incidental, or consequential damages, including loss of profits, data, or business opportunities.
• Our total liability will not exceed the greater of fees paid in the last 3 months or USD $100.

14. Indemnification

You agree to indemnify and hold Elyxis harmless from claims arising from:

• Your use of the Service,
• Your Data,
• Your violation of these Terms,
• Your violation of any laws or rights of others.

15. Termination

You may stop using the Service at any time. We may suspend or terminate your access for violations of these Terms, risks to the Service or other users, discontinuation of early access, or legal requirements. Some obligations survive termination.
